1. Introduction

Welcome to Dervesh Luxe L.L.C-FZ, an e-Commerce Multi-Designer store registered in Dubai. By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Definitions

• “Company” refers to Dervesh Luxe, registered in Dubai.
• “Platform” refers to the Dervesh Luxe website and associated services.
• “Designer” refers to the sellers who list and sell their products on the Platform.
• “Buyer” refers to any individual or entity purchasing products from the Platform.
• “Products” refers to the items listed for sale by Designers on the Platform.

3. Registration and Account

3.1 Eligibility: Both Designers and Buyers must be at least 18 years of age to register and use the Platform.

3.2 Account Information: All users must provide accurate, complete, and up-to-date information during registration. Dervesh Luxe reserves the right to suspend or terminate accounts with inaccurate or incomplete information.

4. Seller (Designer) Obligations

4.1 Product Quality: Designers are solely responsible for ensuring that their products meet the quality standards as described on the Platform. Dervesh Luxe does not provide any guarantees regarding the quality, safety, or legality of the products listed.

4.2 Compliance with Laws: Designers must comply with all applicable laws and regulations, including those relating to the manufacturing, sale, and shipping of their products.

4.3 Order Fulfillment: Designers are responsible for fulfilling orders in a timely manner as per the agreed-upon shipping terms. Any delays or issues with order fulfillment must be communicated directly to the Buyer.

4.4 Product Liability: Designers are liable for any claims arising from defects, damages, or issues related to their products. Dervesh Luxe is not liable for any product-related claims.

4.5 Fees and Payments: Designers agree to pay any applicable fees for listing products on the Platform as outlined in our fee structure. Dervesh Luxe reserves the right to adjust fees with prior notice.

5. Buyer Obligations

5.1 Account Use: Buyers must use the Platform responsibly and must not engage in any activities that violate these Terms and Conditions or any applicable laws.

5.2 Purchases: By placing an order on the Platform, Buyers agree to purchase the product(s) as described and to pay the full amount at the time of purchase.

5.3 Returns and Refunds: Returns and refunds are subject to the policies outlined by each Designer. Buyers must follow the specific return instructions provided by the Designer.

5.4 Disputes: In the event of a dispute with a Designer, Buyers must first attempt to resolve the issue directly with the Designer. If the issue cannot be resolved, Dervesh Luxe may, at its discretion, assist in mediating the dispute but is not obligated to do so.

5.5 Refusal to Receive Parcel: If a Buyer refuses to receive a parcel once it has reached the destination country or their home, the Buyer will be barred from ordering again from the Platform. Dervesh Luxe reserves the right to enforce this policy without prior notice.

6. Limitation of Liability

6.1 Platform Use: Dervesh Luxe provides the Platform “as is” and “as available.” We make no warranties, either express or implied, regarding the Platform’s operation, availability, or the accuracy of the content.

6.2 Third-Party Liability: Dervesh Luxe is not liable for any damages, losses, or injuries resulting from the actions, products, or negligence of Designers or any third parties associated with the Platform.

6.3 Maximum Liability: In no event shall Dervesh Luxe’s total liability to any user exceed the amount paid by the user to Dervesh Luxe in the twelve (12) months preceding the claim.

7. Intellectual Property

All content, trademarks, logos, and intellectual property on the Platform are the property of Dervesh Luxe or its licensors. Users are prohibited from using any intellectual property without prior written consent.

8. Privacy

Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

9. Termination

Dervesh Luxe reserves the right to suspend or terminate any account at its discretion, including for violations of these Terms and Conditions.

10. Governing Law

These Terms and Conditions are governed by the laws of Dubai, United Arab Emirates. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Dubai.

11. Changes to Terms and Conditions

Dervesh Luxe reserves the right to modify these Terms and Conditions at any time. Users will be notified of any changes, and continued use of the Platform will constitute acceptance of the modified terms.
